Service Agreement

FsboFM.com provides an advertising forum for its sellers. FsboFM.com represents neither the buyer nor the seller. Please take a moment to review and understand this Service Agreement. By listing your property on FsboFM.com, you agree to the following terms and conditions:

SERVICE

Our one-time fee of $150 includes up to six months listing time (continuous only) and the use of our sturdy and distinctive “For Sale By Owner” yard sign. This term expires when your property: is sold and the home has closed, is taken off the market, is listed with a real estate agent or broker, or the time period elapses, whichever occurs first.

• The listing may be extended for six months for a fee of $50. 
• Listings are for one property only and are non-transferable.
• The listing is non-refundable, since we incur nearly all of our expenses during the first few days of listing a new property.
• The home seller is responsible for the accuracy of all information posted on the FsboFM.com website. Any owner deliberately misrepresenting their property will be asked to change the inaccuracy. Refusing to do so will result in termination of the listing.
• In order to maintain the accuracy of information that is presented on the FsboFM.com website and to reduce or eliminate any confusion caused by properties being listed in multiple areas for differing prices and with differing information, you must agree to not advertise your property for sale on any other database or real estate websites. Newspaper advertising and non-database websites such as Craigslist are fine and are encouraged.
• No warranty of any kind is implied or provided.
• The listing owner agrees to notify FsboFM.com as soon as listed property is sold, taken off the market, or listed elsewhere.
• Any user submitting a bad check or credit card will be charged a fee of $25 and may be unable to access FsboFM.com’s website in the future.

SIGNS

Our fee includes the use of a sturdy, distinctive FSBO yard sign. Most signs are installed within three business days. Signs will only be delivered and installed within the Fargo-Moorhead metro area. Please see our service area to determine if your location is in our delivery area. Contact us for information regarding use of signs outside this area which would involve a deposit, pick up, and self installation.  Property owners agree to:

• Pay a fee of $50 if the sign is unavailable for pickup after the listing term expires or is damaged beyond normal wear and tear.
• Be aware that FsboFM.com remains the owner of the sign; the homeowner alone is responsible for any injury involved during installation of the sign.
• Not allow any buyers real estate agent to place their realtor sign in the yard of a property listed on FsboFM.com.
• Home seller agrees to place a "SOLD" placard (which will be provided to Seller by FsboFM.com), on the FsboFM.com yard sign upon execution of a purchase agreement, allowing the "SOLD" placard to remain on the yard sign until the closing.
